

A 34-year-old woman and her 17-year-old daughter were in the street when a vehicle driving by hit them both and fled. He was eventually identified. The mother suffered two neck fractures, a pelvic fracture, three leg fractures, crushed right side ribs, a punctured lung by those ribs, and facial lacerations ($5,000,000 default judgment). Her daughter suffered a fractured left femur, fractured pelvis, fractured ribs and injuries to her right arm and face ($500,000 judgment). While boating, the father of the minor plaintiff allowed her to leave her hands outside of the boat, in violation of Coast Guard rules. He drove into a buoy. Her elbow was smashed into the buoy, and they took her to the emergency room bleeding profusely enough to soak her clothing. She suffered an open left humerus fracture. When this incident happened, the plaintiff was a young 15-year-old girl with some learning disabilities. This injury caused her severe problems in furthering her educational goals. As one of the household residents was cutting the lawn, he backed up the tractor, running over the visiting 8- year-old boy, whose legs were caught under the mower’s deck. A 30-year-old mother with her 11-year-old daughter and 10-year-old son as passengers were injured when a drunk driver crossed the center line and hit them head-on. The mother suffered a fracture in her right foot and right ankle which required surgery, but her doctor, an orthopedic surgeon, decided against surgery due to her pregnancy. Today she continues to have problems with her right ankle and foot and it is apparent that this will not totally resolve. The son had gone partially through the windshield and split his forehead to the bone. He has fortunately recovered from his massive lacerations but has incredible scars. The daughter had abrasions on her nose and right ankle pain. She continues to suffer with nose respiratory problems. The uninsured defendant died at the hospital. In February, 2005, a 52-year-old woman parked in the lot of Sam’s Club. She did not know that their practice was to pile plowed snow in an area of the parking lot that was higher than the rest of the lot, and that the snow had then thawed, run over the low part of the lot, and re-froze, creating an unnatural accumulation of ice (black ice). She exited her vehicle and immediately fell and suffered a fractured right shoulder involving immediate surgery. Paid by Pekin Insurance.
On December 11, 2006, a 59 year old man while taking trash out of his rented office space to the bin sitting near the parking lot/driveway slipped on an accumulation of ice on the driveway. The gutter was leaking melted snow onto the driveway which had frozen causing a "black ice" situation. He fell on the ice fracturing his left humerus and left elbow. The gutter and down spout were situated so that any water would run out of the down spout onto the driveway where people would walk to the parking lot and trash bin.
