Despite the darkness and the presence of heavy fog, he failed to place any flares or reflective triangles or any other warning signals to alert the oncoming traffic of the obstruction. Although our client was driving cautiously due to the fog, when he saw the trailer completely blocking the road, he was unable to stop and his truck impacted with the underneath side of the semi-trailer with significant damage and intrusion to the driver’s compartment. The ambulance crew found our client to have abrasions on his left knee, pain in his right knee, abrasions on his upper left arm, and he reported his head hurt. C.R. England.
