$75,000 – The plaintiff’s decedent was driving his semi truck with trailer when he observed an Explorer on the cross street speeding toward him.

Settled. The plaintiff’s decedent was driving his semi truck with trailer when he observed an Explorer on the cross street speeding toward him. The defendant’s decedent disobeyed his stop sign and drove into the intersection in front of the plaintiff’s decedent’s semi truck and they collided. The plaintiff’s decedent sustained injuries to his hands and knees; and Post Traumatic Stress Disorder. The plaintiff’s decedent was so emotionally distraught over the ordeal, that three months later he suffered a fatal heart attack. Nothing in the 52-year-old man’s prior medical records indicated that he suffered from any form of heart disease or hypertension at all, much less anything serious enough to cause his death. The Director of the Coronary Care Unit, NWU Medical School, was hired as an expert, reviewed all of the records, and testified at his deposition that the cause of death was indeed related to the motor vehicle collision. Erie Insurance settled the day before the trial was to begin.
