Medical malpractice is negligence committed by a professional health care provider - a doctor, nurse, dentist, technician hospital, or hospital worker - whose performance of duties departs from the standard of practice of those with similar training and experience, resulting in harm to a patient or patients. Doctors and other healthcare providers must follow certain standards when caring for patients. While a simple mistake is not enough to constitute negligence, a death or serious injury caused by the failure to provide reasonably appropriate or common standards of care or the failure to diagnose an easily detectable illness may be malpractice.
